1.OWND Is Not CIPO

OWND assists with trademark-related preparation, review, classification support, filing support, submission support, monitoring, communication, and related administrative assistance. The final review and decision on any trademark application is made by CIPO or the applicable government authority.

2.Trademark Approval Is Not Guaranteed

Trademark approval is not guaranteed.

After an application is submitted, the review process may take several months. Based on current CIPO processing information, examination may take approximately 7 to 8 months or longer, but actual timelines can change and are outside OWND's control.

Your trademark application may be questioned, delayed, objected to, refused, opposed, abandoned, or not approved if CIPO determines that the trademark is too similar to an existing trademark, business name, logo, design, brand, or other protected mark.

An application may also face issues if the trademark is considered too descriptive, generic, misleading, incomplete, improperly classified, or otherwise not registrable under applicable trademark rules.

3.Similarity Risk Warning

Before purchasing, you should carefully consider whether your trademark, logo, design, business name, brand name, or slogan may be similar to another business, trademark, brand, logo, or design.

CIPO may object to or refuse an application if it believes the trademark is confusingly similar to another trademark or protected mark. OWND cannot guarantee that a trademark will be accepted, approved, or registered.

4.If CIPO Raises an Issue

If CIPO issues an examiner's report, objection, refusal, similarity concern, or other notice, OWND will review the matter and contact you with the available next steps.

This may include reassessing the trademark, reviewing CIPO's concern, discussing possible changes, considering whether a response or amendment may be available, advising on additional options, or explaining whether a new trademark application may be required.
