1.Introduction
This Refund Policy applies to trademark-related services provided by 17967411 Canada Inc., operating under the brand name OWND.
OWND provides private trademark-related services, which may include intake review, client communication, ownership review, trademark review, business name review, logo or design review, classification support, application preparation, filing support, submission support, application monitoring, amendment support, and related administrative assistance.
This Refund Policy explains when a refund may be available, when fees become non-refundable, and what happens if a trademark application is delayed, objected to, refused, opposed, abandoned, or not approved.
2.OWND Is Not CIPO
OWND is a private trademark service provider. OWND is not the Canadian Intellectual Property Office, also known as CIPO, and is not a government agency, government department, official government trademark office, or government representative.
CIPO or the applicable government authority makes the final decision on trademark applications. OWND does not control CIPO's processing timelines, examiner decisions, objections, refusals, approvals, registrations, public records, or government decisions.
3.No Guarantee of Trademark Approval
Trademark approval is not guaranteed.
Your trademark application may be questioned, delayed, objected to, refused, opposed, abandoned, or not approved if CIPO determines that the trademark is too similar to another trademark, business name, logo, design, brand, or protected mark.
An application may also face issues if the trademark is considered too descriptive, generic, misleading, incomplete, improperly classified, or otherwise not registrable.
A refusal, objection, delay, opposition, abandonment, similarity concern, or non-approval does not automatically entitle the client to a refund.
4.Service Fee and Government Filing Fee
The amount paid to OWND may include two parts:
- Government Filing Fee — the amount paid to CIPO or another applicable government authority for the trademark application.
- OWND Service Fee — the amount paid to OWND for review, preparation, classification support, filing support, submission support, application monitoring, communication, and related administrative work.
For a standard one-class Canadian trademark application, the CIPO government filing fee is approximately $500, depending on the official CIPO fee in effect at the time of submission. CIPO fees may change from time to time.
For example, if the total package price is $1,500, the amount may be split approximately as follows, unless otherwise stated at checkout or in writing:

5.Refund Request Timeline
Unless a different refund request period is stated at checkout or in writing, refund requests must be made within 24 hours of payment and before OWND has started reviewing, preparing, processing, classifying, submitting, or otherwise working on the trademark file.

A refund request does not guarantee that a refund will be approved. Refund eligibility depends on:
- When the refund request was made;
- Whether OWND has started work;
- Whether OWND has reviewed the trademark or application information;
- Whether the application has been prepared;
- Whether the application has been submitted to CIPO;
- Whether government filing fees have been paid;
- Whether payment processing or administrative costs have been incurred; and
- The terms of this Refund Policy.
6.Refund Before Work Begins
If the client requests a refund within the applicable refund request period and OWND has not started any work on the file, OWND may issue a refund, subject to any payment processing fees, administrative costs, or other non-recoverable charges.
Work may include, but is not limited to:
- Reviewing the client's intake form;
- Reviewing the business name, logo, design, brand name, or slogan;
- Reviewing ownership details;
- Reviewing goods or services;
- Preparing or classifying the application;
- Communicating with the client about the application;
- Preparing documents or filing details;
- Submitting information to CIPO or another authority;
- Monitoring or managing the file.
7.After OWND Starts Work
Once OWND has started reviewing, preparing, processing, classifying, or working on the trademark file, OWND's service fee may be considered earned in whole or in part. This is because OWND has started providing the service requested by the client.
If the client cancels after OWND has started work but before submission to CIPO, OWND may retain all or part of the service fee for work already completed, time already spent, administrative processing, review, preparation, classification, or other work performed on the file.
Any refund, if approved, will be determined at OWND's discretion based on the stage of work completed and any costs already incurred.
8.After Application Review or Preparation
Once OWND has reviewed the trademark information, reviewed ownership details, reviewed the logo or design, reviewed the business or brand name, reviewed goods or services, prepared application information, or completed classification-related work, the service fee is generally non-refundable.
This applies even if the client later decides not to proceed, changes their mind, chooses a different trademark, or believes the trademark may be similar to another business, brand, logo, design, or trademark.
9.After Submission to CIPO
Once the trademark application has been submitted to CIPO or another applicable government authority, refunds are generally not available. This is because:
- The CIPO government filing fee has been paid or incurred;
- OWND has completed the review, preparation, filing, and submission work;
- OWND has started the post-submission monitoring or administrative process; and
- The application is now subject to CIPO's review process and timelines.
Government filing fees are generally non-refundable once paid to CIPO or another government authority.
OWND's service fee is also generally non-refundable after submission because the review, preparation, filing, submission, and initial application management work has been performed.
10.If the Application Is Objected To, Refused, Delayed, Opposed, or Not Approved
If CIPO later issues an examiner's report, objection, refusal, similarity concern, opposition notice, delay, or other notice, this does not create an automatic right to a refund.
CIPO may object to or refuse an application if the trademark is too similar to another trademark, business name, logo, design, brand, or protected mark. CIPO may also raise issues for other legal, technical, classification, ownership, descriptiveness, or filing reasons.
If this happens, OWND will review the matter and contact the client with available next steps. Available next steps may include:
- Reassessing the trademark;
- Reviewing CIPO's concern;
- Discussing possible changes;
- Considering whether a response may be available;
- Considering whether an amendment may be available;
- Advising that additional information is needed;
- Advising that legal advice, a trademark agent, or a lawyer may be required;
- Advising that a new trademark application may be required.
Additional work may require additional fees unless expressly included in the purchased package.
11.New Trademark Applications
If the original application cannot proceed, is refused, is abandoned, is withdrawn, or the client chooses to apply for a different trademark, a new trademark application may be required.
A new trademark application requires a new government filing fee and a new OWND service fee. This is because OWND must review the new trademark, review ownership and business information where applicable, prepare a new application, classify the goods or services, submit the new filing, and monitor or manage the new application process.
Clients who wish to apply again for another trademark may contact OWND to begin a new application. The same fee or an updated service fee may apply depending on the package selected, the CIPO filing fee in effect, the number of classes, and the work required at that time.
12.Similarity Risk Before Purchase
Before purchasing, clients should consider whether their trademark, logo, design, business name, brand name, or slogan may be similar to another business, trademark, brand, logo, or design.
If the client believes the trademark may be similar to another business or brand, the client should carefully review OWND's Privacy Policy, Trademark Application Disclaimer, and Refund Policy before purchasing.
Once payment is made and OWND starts reviewing, preparing, processing, or working on the trademark file, the service fee may become non-refundable in whole or in part. Once the application is submitted to CIPO, both the CIPO government filing fee and OWND's service fee are generally non-refundable.
13.Client Responsibility
The client is responsible for providing accurate, complete, truthful, current, and lawful information. This includes:
- Legal name;
- Business owner name;
- Business name;
- Contact information;
- Billing information;
- Ownership details;
- Logo files;
- Design files;
- Brand names;
- Slogans;
- Goods and services information;
- Trademark-related materials;
- Any other information required for the service.
OWND is not responsible for delays, objections, refusals, abandoned applications, losses, disputes, or additional costs caused by inaccurate, incomplete, misleading, unauthorized, or late information provided by the client.
14.Payment Processing Fees
Refunds, where approved, may be reduced by payment processing fees, administrative fees, chargeback fees, currency conversion costs, or other non-recoverable costs charged by banks, card networks, payment processors, or third-party providers.
If taxes were charged, any tax refund will be handled according to applicable tax rules and only to the extent connected to an approved refund.
15.Chargebacks and Payment Disputes
If a client files a chargeback or payment dispute after OWND has started work, reviewed the application, submitted the application, or completed the service, OWND may provide evidence to the payment processor, bank, card network, or dispute-resolution provider.
This evidence may include:
- Payment records;
- Service records;
- Client communications;
- Intake forms;
- Uploaded files;
- Consent and acknowledgment records;
- Checkbox confirmations;
- Application preparation records;
- Submission records;
- CIPO filing information;
- Refund Policy acceptance records.
16.Approved Refund Processing Time
If a refund is approved, OWND will process the refund using the original payment method where reasonably possible.
Approved refunds may take several business days to appear on the client's card, bank account, or payment method, depending on the payment processor, card network, bank, or financial institution.

- Date of purchase;
- Service purchased;
- Reason for the refund request.
OWND will review the request based on this Refund Policy, the stage of work completed, whether the application has been reviewed or submitted, whether government fees have been paid, and applicable law.
18.Changes to This Refund Policy
OWND may update this Refund Policy from time to time. The updated version will be posted on our website with the revised effective date.
Refund rights for a specific purchase will generally be based on the Refund Policy in effect at the time of purchase, unless otherwise required by law.
